Terms of Service for Hadaya

Welcome to Hadaya! By using our app, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing and using Hadaya, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the app.

2. Description of Service

Hadaya is a gift wishlist management application that allows users to:

Create and manage wishlists for various occasions
Share wishlists with friends and family
Claim gifts privately
Search for friends using the app
Sync data across devices using iCloud

3. User Accounts

3.1 Registration:

You must provide accurate and complete information
You must be at least 13 years old to use Hadaya
You are responsible for maintaining the security of your account
You must not share your account credentials

3.2 Account Security:

Keep your password confidential
Notify us immediately of any unauthorized use
You are responsible for all activities under your account

4. User Conduct

You agree NOT to:

Use the app for any illegal purposes
Harass, abuse, or harm other users
Upload malicious code or viruses
Attempt to gain unauthorized access to our systems
Scrape or collect data from the app
Impersonate others
Create fake accounts
Spam other users

5. User Content

5.1 Your Content:

You retain ownership of content you create (wishlists, gift items)
You grant us a license to store and display your content
You are responsible for your content
We may remove content that violates these Terms

5.2 Prohibited Content:

Illegal or harmful content
Offensive or inappropriate material
Content that violates others’ rights
Spam or misleading information

6. Intellectual Property

6.1 Our Rights:

Hadaya and its content are protected by copyright and trademark laws
You may not copy, modify, or distribute our app without permission
The Hadaya name and logo are our trademarks

6.2 Your Rights:

You retain all rights to your user content

7. Third-Party Services

7.1 Apple Services:

We use Apple’s CloudKit for data storage
We use Apple’s Contacts framework (with your permission)
These services are governed by Apple’s Terms: https://www.apple.com/legal/internet-services/itunes/

7.2 External Links:

Gift links may direct to external websites
We are not responsible for external content
Use external links at your own risk

8. Privacy

Your use of Hadaya is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

9. Data and iCloud

9.1 iCloud Sync:

Data syncing requires an active iCloud account
You are responsible for iCloud storage space
Data sync is provided “as is”

9.2 Data Backup:

We recommend backing up important data
We are not responsible for data loss

10. Disclaimers

10.1 Service “As Is”:

Hadaya is provided “as is” without warranties
We do not guarantee uninterrupted service
We do not guarantee error-free operation

10.2 No Gift Guarantees:

We do not guarantee that gifts will be purchased
Users are responsible for their own gift decisions
We are not involved in gift transactions

11. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, or consequential damages
Our total liability is limited to the amount you paid us (if any)
We are not liable for:
- Data loss
- Service interruptions
- User disputes
- Third-party actions

12. Termination

12.1 By You:

You may delete your account at any time
All your data will be permanently deleted

12.2 By Us:

We may suspend or terminate accounts that violate these Terms
We may discontinue the service with notice

13. Changes to Terms

We may update these Terms from time to time. Changes will be effective:

When posted in the app
With updated “Last Updated” date
We will notify you of significant changes

Continued use after changes means you accept the new Terms.

14. Governing Law

These Terms are governed by the laws of Saudi Arabia, without regard to conflict of law provisions.

15. Dispute Resolution

15.1 Informal Resolution:

15.2 Arbitration:

Any disputes will be resolved through binding arbitration
You waive the right to a jury trial
Class actions are not permitted

16. General

16.1 Entire Agreement:

These Terms constitute the entire agreement between you and us

16.2 Severability:

If any provision is invalid, the rest remain in effect

16.3 No Waiver:

Our failure to enforce a right does not waive that right

مرحباً بك في هدايا! باستخدامك لتطبيقنا، فإنك توافقين على شروط الخدمة هذه. يرجى قراءتها بعناية.

١. قبول الشروط

بالدخول واستخدام تطبيق هدايا، فإنك تقبلين وتوافقين على الالتزام بشروط الخدمة هذه وسياسة الخصوصية الخاصة بنا. إذا كنت لا توافقين، يرجى عدم استخدام التطبيق.

٢. وصف الخدمة

هدايا هو تطبيق لإدارة قوائم الأمنيات للهدايا يتيح للمستخدمين:

إنشاء وإدارة قوائم الأمنيات لمناسبات مختلفة
مشاركة القوائم مع الأصدقاء والعائلة
حجز الهدايا بشكل خاص
البحث عن الأصدقاء الذين يستخدمون التطبيق
مزامنة البيانات عبر الأجهزة باستخدام iCloud

٣. حسابات المستخدمين

٣.١ التسجيل:

يجب تقديم معلومات دقيقة وكاملة
يجب أن يكون عمرك 13 عاماً على الأقل لاستخدام هدايا
أنت مسؤولة عن الحفاظ على أمان حسابك
يجب عدم مشاركة بيانات اعتماد حسابك

٣.٢ أمان الحساب:

احتفظي بكلمة المرور سرية
أخطرينا فوراً في حالة الاستخدام غير المصرح به
أنت مسؤولة عن جميع الأنشطة تحت حسابك

٤. سلوك المستخدم

توافقين على عدم:

استخدام التطبيق لأي أغراض غير قانونية
مضايقة أو إساءة أو إيذاء المستخدمين الآخرين
تحميل أكواد ضارة أو فيروسات
محاولة الوصول غير المصرح به إلى أنظمتنا
جمع البيانات من التطبيق
انتحال شخصية الآخرين
إنشاء حسابات مزيفة
إرسال رسائل غير مرغوب فيها للمستخدمين

٥. محتوى المستخدم

٥.١ محتواك:

تحتفظين بملكية المحتوى الذي تنشئينه (قوائم الأمنيات، عناصر الهدايا)
تمنحيننا ترخيصاً لتخزين وعرض محتواك
أنت مسؤولة عن محتواك
قد نزيل المحتوى الذي يخالف هذه الشروط

٥.٢ المحتوى المحظور:

المحتوى غير القانوني أو الضار
المواد المسيئة أو غير اللائقة
المحتوى الذي يخالف حقوق الآخرين
الرسائل غير المرغوب فيها أو المعلومات المضللة

٦. الملكية الفكرية

٦.١ حقوقنا:

هدايا ومحتواها محمي بموجب قوانين حقوق النشر والعلامات التجارية
لا يجوز لك نسخ أو تعديل أو توزيع تطبيقنا بدون إذن
اسم وشعار هدايا هما علامتان تجاريتان لنا

٦.٢ حقوقك:

تحتفظين بجميع الحقوق في محتوى المستخدم الخاص بك

٧. خدمات الطرف الثالث

٧.١ خدمات Apple:

نستخدم CloudKit من Apple لتخزين البيانات
نستخدم إطار جهات الاتصال من Apple (بإذنك)
تخضع هذه الخدمات لشروط Apple: https://www.apple.com/legal/internet-services/itunes/

٧.٢ الروابط الخارجية:

قد توجه روابط الهدايا إلى مواقع خارجية
نحن لسنا مسؤولين عن المحتوى الخارجي
استخدمي الروابط الخارجية على مسؤوليتك

٨. الخصوصية

يخضع استخدامك لهدايا أيضاً لسياسة الخصوصية الخاصة بنا. يرجى مراجعتها لفهم كيفية جمعنا واستخدامنا لمعلوماتك.

٩. البيانات وiCloud

٩.١ مزامنة iCloud:

تتطلب مزامنة البيانات حساب iCloud نشط
أنت مسؤولة عن مساحة تخزين iCloud
يتم توفير مزامنة البيانات “كما هي”

٩.٢ النسخ الاحتياطي للبيانات:

نوصي بعمل نسخة احتياطية من البيانات المهمة
نحن لسنا مسؤولين عن فقدان البيانات

١٠. إخلاء المسؤولية

١٠.١ الخدمة “كما هي”:

يتم توفير هدايا “كما هي” بدون ضمانات
لا نضمن خدمة دون انقطاع
لا نضمن عملية خالية من الأخطاء

١٠.٢ عدم ضمان الهدايا:

لا نضمن أن يتم شراء الهدايا
المستخدمون مسؤولون عن قرارات الهدايا الخاصة بهم
نحن لسنا متورطين في معاملات الهدايا

١١. حدود المسؤولية

إلى أقصى حد يسمح به القانون:

نحن غير مسؤولين عن الأضرار غير المباشرة أو العرضية أو التبعية
مسؤوليتنا الإجمالية محدودة بالمبلغ الذي دفعته لنا (إن وجد)
نحن غير مسؤولين عن:
- فقدان البيانات
- انقطاع الخدمة
- نزاعات المستخدمين
- أفعال الطرف الثالث

١٢. الإنهاء

١٢.١ منك:

يمكنك حذف حسابك في أي وقت
سيتم حذف جميع بياناتك نهائياً

١٢.٢ منا:

قد نوقف أو ننهي الحسابات التي تنتهك هذه الشروط
قد نوقف الخدمة مع إشعار

١٣. تغييرات على الشروط

قد نقوم بتحديث هذه الشروط من وقت لآخر. ستكون التغييرات سارية:

عند نشرها في التطبيق
مع تحديث تاريخ “آخر تحديث”
سنخطرك بالتغييرات الكبيرة

الاستخدام المستمر بعد التغييرات يعني قبولك للشروط الجديدة.

١٤. القانون الحاكم

تخضع هذه الشروط لقوانين المملكة العربية السعودية، دون مراعاة أحكام تنازع القوانين.

١٥. حل النزاعات

١٥.١ الحل غير الرسمي:

اتصلي بنا أولاً لحل النزاعات بشكل غير رسمي

١٥.٢ التحكيم:

سيتم حل أي نزاعات من خلال التحكيم الملزم
تتنازلين عن الحق في محاكمة أمام هيئة محلفين
الدعاوى الجماعية غير مسموح بها

١٦. عام

١٦.١ الاتفاقية الكاملة:

تشكل هذه الشروط الاتفاقية الكاملة بينك وبيننا

١٦.٢ قابلية الفصل:

إذا كان أي حكم غير صالح، يظل الباقي ساري المفعول

١٦.٣ عدم التنازل:

عدم ممارستنا لحق لا يعني التنازل عن ذلك الحق
